The police come, fill out a report, give the party with no liscense and insurance tickets, then you have two choices:

1) Let your insurance rates go way up and make your insurance fix your car. Not recommended, your insurance will only go up a couple times before they finally level you off again.

2) pay for it yourself and eat the loss.

This happened to me a few years back and it REALLY pissed me off. If you do have your insurance cover the damage they will go after the person that hit you, but my buddy is my insurance agent and he basically said that they have no re-course against the other party anyway. They can call and push the person to pay out of their own pocket, but 99% of the time the people driving with no insurance are ones that can't afford it.

I suggest that you find out when the court date is of the person hat hit you and show up. Be there to tell the judge that you are the one they hit and that you do not want hem to be let off, or the judge will drop all charges if they can show 'proof' of insurance since the accident. I couldn't believe this when I heard it so I showed up at the date of the woman which hit me.....and low and behold they were about to drop charges when I stood up and told the judge that the girl has caused me, my truck, and my insurance damage. I had to explain the accident and how the girl has avoided paying me for HER fuck up, but the judge hit her wth $750 worth of fines. It's kind of embarassing how our system works sometimes.

I didn't get anything out of it, but I did get the satisfaction of seeing the girls face who fell asleep at the wheel and rear ended me (at 6 am) get hit with some good fines that she'll HAVE to pay. Sorry for the rant, I guess this situation does still anger me....but hopefully it goves someone else some good information.
